With the announcement that new powers are to be handed down to the Ministry of Justice’s Claims Management Regulation Unit (CMRU), those annoying text messages stating “Act now! We have £4,000 in compensation waiting for you” or “For a free iPad, text this number and claim compensation for your injuries” etc. could be a thing of the past.

Although a potential sum of money and a free iPad may be tempting for some people, most of us know to avoid these companies like the plague. Yet thousands of people all over the country are falling for these unsolicited texts and nuisance calls, taking up compensation claims for genuine injuries with firms who do not always deliver.

Unfortunately those who do fall for this trap and decide to pursue a claim with one of these types of claims firms are regularly undercompensated for their injuries, meaning they are missing out on what they deserve – if of course the claim is handled correctly.

The regulator is looking to impose new rules on firms who offer incentives or employ cold calling and texting methods, warning them that they could be fined up to 20% of their yearly turnover if they pursue this form of spamming the public. In addition, the government is also planning to introduce a complete ban on incentives whether it be £250 for a claim or a free iPad, promising to crack down on these schemes, as many clients never receive the money or benefits promised due to stringent “terms and conditions”.

Alastair Fernie is Managing Director of Freeclaim Solicitors and a strong campaigner against these types of tactics which give the industry a bad name,

“There are many companies who quite unashamedly are maximising as much profit as they can from the personal injury sector. Many operate with poorly trained call centre staff and their business models rely on processing high volumes of claims and minimum contact with clients. This approach means that many cases have been mishandled and clients were left completely under compensated for their injuries.

The forthcoming changes should help, but we are still seeing many firms operating like ‘sausage factories’, dealing with high volumes of claims at the lowest cost possible.

We would always strongly recommend that anyone who has been injured in an accident seek advice from a firm of specialist solicitors who can prove a track record of success in handling injury claims and can demonstrate high levels of client care.”

Freeclaim Solicitors are urging anyone who has suffered a personal injury to seek legal advice from regulated solicitors who specialise in this area. When you make an enquiry, ensure you ask what accreditations they have and how long they have been helping clients who have been injured. Always ask the question do they have your best interests at heart? A free iPad may be one thing, but you need to ensure that you receive the correct amount of compensation for your injuries and ensure your solicitor can help with rehabilitation and helping to rebuild your life.

When you decide to make a claim with Freeclaim Solicitors, you can be confident that you are choosing an independent and experienced legal firm that has your best interests at heart.
