Cornwall Council has paid out over £780,000 in accident compensation over the last 4 years. These payouts were for people who have sustained personal injury due to poorly maintained pavements, as well as injuries caused by potholes and other safety failings by the council.

It is thought around £40,000 a year is paid out by the council after people have been injured when they have fell on steps, and a further £30,000 paid out to people injured due to potholes. These figures show that more needs to be done by councils to keep our roads and pavements in reasonable repair.

A cabinet member from Cornwall Council commented saying, “The duty of the council is to keep our roads and pavements in good order and, when a problem is reported, we have to take action to fix it as quickly as possible. Where someone suffers damage or injury as a result of council inaction, we will of course, pay fair compensation.”

Following an accident on public property or on a public highway, people sometimes believe that they cannot claim compensation, as it is not on private property. This is not the case. Local authorities and councils have a duty of care to ensure that all pavements, highways and public pathways are maintained to a reasonable standard. They should monitor and maintain these areas to make sure they do not go into disrepair.

If you have been injured due to a trip on a defective pavement or pothole in the road, you may be able to make a claim for accident compensation. It is important to speak to a specialist personal injury solicitor with the legal expertise and track record of success in these difficult cases.

At Freeclaim Solicitors we have many years experience helping clients to claim compensation from their local council following slips, trips and falls, as well as many other accidents.
