Each year, many people are injured in accidents on planes. Whether it’s from luggage moving and falling from overhead lockers, tripping hazards, hot drinks being spilt or bad turbulence, nobody wants to find themselves hurt whilst travelling on a plane.
Accidents on planes are covered by the Montreal Convention, which allows people who are injured whilst on board a plane, or upon boarding and disembarking, to claim compensation for their injuries. However, there are different rules for these types of compensation claims compared to other claims.
- You must make a claim within two years of the accident occurring, which is shorter than the usual amount of time you have to make a claim.
- Also, no matter where the accident occurred, you can bring a claim for compensation in your home country, you do not have to bring the claim where the accident occurred.
We have recently been instructed by two clients in an interesting case after they suffered injuries on board a plane whilst heading off on their holidays.
Both had their seatbelts on and were preparing for take-off. As the plane was on the runway and accelerating at speed, suddenly and without any warning, the pilot slammed on the brakes and aborted the take-off because the aircraft’s instruments indicated that there was an engine fire.
They were both thrown forward and then backwards, jarring their necks and backs as a result. All the passengers were asked to remain calm. They were then ushered off the plane and transferred to another aircraft which took them to their destination with a delay of a few hours.
Both clients were checked over at the hospital and advised that they suffered soft tissue injuries to their necks and backs. They have also been having nightmares and have been afraid to fly since the incident. One of our clients was planning a short break abroad shortly after the accident but after the incident, became too scared to fly and is still unable to contemplate flying in the near future.
