The Package Travel, Package Holidays and Package Tours Regulations 1992 apply to all package holidays and it allows you to claim compensation in certain circumstances.

You can bring an accident abroad compensation claim against the Package Tour Operator (and sometimes the travel agent) for compensation for pain and suffering, any loss or expense sustained and for the loss of enjoyment of the holiday.
Large numbers of people now book their flights through a budget airline and their hotel on the internet, or alternatively use a travel agent who will book separate components of the holiday at separate prices, thereby keeping itself distanced from the final contractual arrangements giving them an opportunity to avoid liability. Even if you did not travel as part of a package holiday, it may still be possible to bring a holiday compensation claim against the person or the organisation that caused your injury or illness.
