Holiday Illness Compensation
When you’re on holiday enjoying time with family and friends, the last thing you want to happen is for you or one of your travel companions to develop food poisoning and become ill. It could potentially ruin your holiday, and the effects may continue long after you have returned home.
If you have suffered food poisoning whilst on a package holiday, you may be able to claim compensation. Food poisoning is usually caused by a bacterial infection in the food or drink you have consumed, caused by poor hygiene practices in the storage and preparation of food, or the food not being cooked properly.
At Freeclaim Solicitors, we can advise you on making a claim after suffering food poisoning whilst on holiday, whether at an all-inclusive resort or hotel or on a cruise ship.
If you have suffered food poisoning whilst on holiday, contact our specialist holiday illness compensation solicitors today on 0800 612 7340 (open 24 hours). Or you can fill in your details online.
About holiday food poisoning
When you are on holiday abroad, food standards in hotels and restaurants can be lower than those in the UK, so food poisoning can easily be contracted. Symptoms of food poisoning can include vomiting, abdominal pain, and diarrhoea. Usually, these symptoms resolve after a few days, but sometimes long-term gastrointestinal conditions can occur. If you suffer food poisoning whilst you are on holiday you should try to:
- Take samples of the food or drink that you believe has made you ill.
- Keep a diary of all of the food and drink you have consumed (including what you have eaten/drank where and when). This can be easier to recall whilst you are still away, rather than when you return home.
- Take photographs or videos of poor hygiene practices you may see.
- Get the contact details of anyone else at the resort, hotel or on board the cruise ship who have also become ill.
- Report/complain to the hotel and tour operator about your suspicions of food poisoning.
- If you see a doctor, ask for any medical records which confirm food poisoning.
However, if you have been unable to do any of the above, do not worry as we will investigate your claim for you.
Claiming holiday illness compensation
Tour operators and hotels have a duty of care to ensure that any food or water served is fit for human consumption. If this is not the case and you become ill as a result, you have the right to claim compensation.
If you booked your holiday as part of a package holiday, whether it was all inclusive, full board or half board, then your rights should be covered by The Package Travel, Package Holidays and Package Tours Regulations 1992.
Often, people have saved over a period of time to enjoy a holiday abroad, so you should be compensated for your pain and discomfort. If you have suffered holiday illness due to food poisoning, you should speak to a specialist holiday illness compensation solicitor as soon as possible. There are often differing limitations to how long you have to make a claim, so it is important to start the process as quickly as possible.
At Freeclaim Solicitors, we have the knowledge and expertise to fight for your claim and will work tirelessly to prove that the food poisoning you experienced was as a result of poor hygiene at the hotel, resort or cruise ship you were visiting.
