Mr. J was a pedestrian who suffered a rib injury after being hit by the Defendant’s vehicle following an altercation between them. The Defendant entered a guilty plea for dangerous driving and actual bodily harm. The Defendant’s insurer argued that they had no liability to meet Mr. J’s damages by relying on case law which suggested that the Defendant’s policy of insurance would not cover the Defendant against the deliberate act of colliding with Mr. J.
