Alastair Fernie recently secured damages of £2.9m on behalf of a client who suffered brain damage following a motorcycle accident involving difficult issues with regards to liability, loss of earnings and care costs. It is worthy of note that this was a case in which a previous firm of solicitors advised that there were insufficient chances of success to proceed further.
In another case, Alastair has now won damages of £1.8m on behalf of his 56 year old client who suffered severe head injuries when knocked down in a road accident. The compensation means that she can now live as fulfilling a life as possible with her husband and family in adapted accommodation, with the support of a case manager and a team of carers.
John Barstow recently took a case to trial on behalf of a client who suffered a spinal injury resulting in paraplegia having fallen over a low wall outside his rented home, which had a significant fall on the other side of it. John managed to establish liability against the landlord for not erecting a handrail although his client was found to have significantly contributed to the accident.
We are currently dealing with two industrial disease cases expected to be settled for over £250,000 each, including one case relating to Mesothelioma (asbestos related disease).
Mr M received £45,000 damages in a vigorously defended repetitive strain injury claim against his employers.
Mrs S received £25,000 damages after an accident at work.
Ms T received a burn to her thigh after a microwave hot water bottle she was using melted. We successfully recovered £4,000 compensation.
Ms H was a front seat passenger involved in a car accident. She sustained a major knee injury and received £35,000 in compensation.
Mr W was trampled by a horse at work and suffered whiplash and concussion. We recovered £2,500 in compensation.
Mr X suffered posttraumatic stress disorder and suffered smoke inhalation during a fire whilst he was serving in the army, which caused a colleague's death. He received £140,000 in compensation.
Ms S suffered psychological trauma when she received a needle stick injury in her new council house, which had been occupied previously by a known drug user. We successfully recovered £4,250.
Mr B suffered chronic post traumatic stress disorder after an incident whilst serving in the army and received £450,000 damages.
Mr S received £40,000 in a claim against the police for wrongful arrest, false imprisonment, malicious prosecution and assault.
Mr B received £21,525 in damages for his broken ankle after tripping on a path on a council estate.
Mr W suffered low back injury and received £12,000 damages in a manual handling claim.
Mr R was involved in an accident in Kenya whilst serving in the army and received £55,000 in a claim against the Ministry of Defence (MOD).
Mr C suffered injuries from an assault in prison and was awarded £5,500.
Mr H suffered a major accident at work. Even though he was claiming benefits, we could still pursue a claim for compensation and he received nearly £300,000.
We are currently working with two victims of road accidents who have had interim payments awarded of £200,000 and £250,000 to fund the set up of a care regime and purchase suitable accommodation due to their severe brain damage.
We have also worked with victims of child abuse from the 1960's and 1970's, who suffered sexual abuse and psychological damage whilst in care in Children's Homes. They have received over £150,000 in compensation.
