A substantial number of accidents occur to visitors at someone else's property. Accidents may arise as a result of a defect in the property itself, or as a result of an activity being carried out on it. Stairs are a common cause of accidents, whether the nosings are improperly fitted or inadequate provision of handrails. It is not compulsory for occupiers to have insurance which covers accident claims, unlike employers for workplace accidents. Insurance may be public liability insurance if the accident occurred in a shop, or household contents insurance for a private home. Where the property is tenanted, a claim may be made against the landlord. Negligence must be proved against the occupier for a claim to succeed.
