What should I do or say in an accident?

Will I have to see a medical expert?
Yes, you will need to see a medical consultant in the near future to determine the nature and extent of your injuries (there will be no cost to you providing you keep your appointment).
If you have continuing injuries, it is essential that you liase with you GP or your local hospital to continue necessary treatment. We can also arrange physiotherapy.
What if the Defendant is Uninsured?
You can still claim compensation - we will submit an application to the Motor Insurers Bureau. If the defendant is uninsured but we can trace the driver of the vehicle, then we will be able to obtain your compensation in full (subject to complying with the Motor Insurers' Bureau rules).
Can I claim if my husband/wife/friend was driving and they were to blame?
When occasionally as accident happens as a result of a member of the family or friend driving the car, you can still pursue a claim against that individual and their insurers. Obviously we would hope that the claim could be settled sensibly without the need for any conflict.
What happens to my No Claims Bonus?
If your claim is 100% successful then your insurance company should hopefully reinstate your No Claims Bonus and refund any additional premiums paid. During the lifetime of your claim however your No Claims Bonus is in a state of limbo and you may not get the full benefit of it if you have to renew before an admission of liability is received from the Defendants.
Also, if your insurers make a payment to any other party involved in the accident or concede liability, even if it is only on a percentage basis, then your no Claims Bonus will be affected (unless you had it protected).
What if the other driver has driven off?
If the other driver has driven off and is untraceable, we can still obtain compensation on your behalf through the Motor Insurers' Bureau Untraced Drivers Scheme.
Do I have to pay for any treatment received?
You may need to pay your emergency hospital fee initially, however, your own insurance company should refund the emergency hospital fee and this will not affect your No Claims Bonus. If you are successful, we should be able to recover any other medical fees
What happens if I need a hire car?

What about vehicle repairs?
If your vehicle needs repairing, then we can arrange for an engineer to come out and inspect the vehicle and recover the cost of its pre-accident market value or alternatively the cost of repairs. Sometimes insurance companies would rather handle repairs themselves. If you are in any doubt, please contact us first and we will help you get back on the road.
How long can I claim travel expenses?
Normally, you should be able to recover travelling expenses until your vehicle is repaired, or if your vehicle is a total loss, for 5 days after you receive your settlement cheque (and payment for the loss of use of your vehicle). You can also recover travelling expenses for visits to your doctor or other specialists - please ensure you keep receipts.
How long will it take?
This will depend on the Defendants and the lifespan of your injury. Your lawyer will advise you throughout your case. Our aim is to get you the best possible outcome as quickly as possible. |
