Success for Freeclaim Solicitor against Police
Mon 8th Dec 08 - 12:24
In a highly publicised case, Mrs Braithwaite, a client of Freeclaim Solicitors (formerly Tranters Freeclaim Solicitors), suffered injuries after a reversing police patrol car knocked her to the ground. Mrs Braithwaite suffered bruising and sprains when the police car hit her leg.
Freeclaim Solicitor, Victoria Cox, decided to take on the accident claim against Greater Manchester Police, even though the Police heavily contested liability after witnesses challenged our client's version of the incident, including a paramedic who was in a line of traffic on the road. This was also the police officer's second accident.
However, Victoria Cox established at the trial that Mrs Braithwaite's version of events was both honest and reliable, as found by District Judge Haigh who added that our client was a reliable witness and the paramedic's version of events was "consistent with paying attention to traffic conditions and observing the accident in his peripheral vision".
Freeclaim Solicitors successfully won the case and Mrs Braithwaite received £4,000 in damages. Plus, the police officer concerned underwent a driver's refresher course.
Mrs Braithwaite commented in the local press (Manchester Evening News), "I don't think there is anything else Tranters Freeclaim could have done for me. The other side were stubborn and dragged my claim out all the way to a trial. But I told the truth throughout and Tranters Freeclaim backed me all the way. At the end of the day the Judge recognised this and justice was done. I feel vindicated by the Judge's decision."
