Possible Compensation Claims By Relatives

An Inquest finding may pave the way to relatives making claims of compensation for the death of relatives being cared for at Gosport War Memorial Hospital more than ten years ago.
The Inquest jury found that the deaths of five patients were contributed to by the medication they were given. This could give rise to a claim for medical negligence which might include the pain and suffering of the deceased. The families may allege a lack of care in formulating a claim for compensation in what is possibly going to be a landmark case.
Director, Steve Tranter comments “It is likely that personal injury solicitors will be instructed with a view to formulating compensation claims on a “no win, no fee” basis. In any compensation claim, the relatives will need to demonstrate that the cause of death was due to inappropriate medication being given, rather than other causes. The level of compensation might also reflect the fact that the relatives were being cared for by staff who are obliged to exercise proper care and this could affect the claim for compensation and specifically the level of compensation.”
